1. PURE CLAVE.
Administrator of personal data collected through the website www.pureclave.pl (hereinafter referred to as the "website") is a company conducting business in the form of a limited liability company under the name of PURE CLAVE Sp. z o. o., registered office and delivery address: 21 Powstania Styczniowego Street, 81-519 Gdynia, NIP: 9580982035, REGON: 191317763, e-mail address: info@pureclave.pl, hereinafter referred to as "Administrator" and/or "PURE CLAVE".
Personal data collected by the Administrator through the website are processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 on the protection of natural persons with regard to the processing of personal data and on the free flow of such data and repealing Directive 95/46/EC (General Data Protection Regulation), hereinafter referred to as RODO and the Law of May 10, 2018 on the Protection of Personal Data.

2. HOW DO WE COLLECT YOUR PERSONAL INFORMATION?
We collect your personal data primarily from you. Your provision of data is voluntary, but in many cases it is necessary for us to perform certain activities (e.g. order processing).
Thanks to the fact that you provide your data, we can, among other things, create an account for you in our online store and subscribe you to our Newsletter. Thanks to the fact that you provide us with your additional personal data, concerning, for example, your home address or your Tax Identification Number, we can realize for you the sale of equipment and/or services in our online store. We also collect your data from you in connection with complaints and when you contact us, e.g. by phone or email.
Our online store gives you the opportunity to log in or create an account, as well as make payments using external services. In the case of logging in using external services, the owner of the service will provide us with your name and email address, and in the case of payment using external services, we will receive your payment status and email address.
We use cookies and other similar technologies in our online store, which you can learn more about in the Cookie Policy (discussed below).
3. FOR WHAT PURPOSE AND ON WHAT LEGAL BASIS DO WE PROCESS YOUR PERSONAL DATA?
We allow you to maintain a Customer Account in our online store - you can set up a Customer Account in our online store, which allows you, among other things, to track your order history, obtain information about the stage of completion of your order. We process your data as it is necessary for the performance of the contract for maintaining a Customer Account as a digital service, which you can conclude with us in accordance with the rules described in the regulations of our online store.
We process sales - because you give us your personal data we can receive payment, deliver goods to you, issue sales documents, and settle sales. We process your data because it is necessary for the performance of the sales contract we have concluded with you, and also because we are under certain legal obligations, such as those arising from tax regulations.
We accept complaints and statements of withdrawal - if you wish to make a complaint or a return, we will process your data for the purpose of fulfilling your requests, i.e. processing the complaint or handling the return. We process your data because it is necessary for the performance of the contract, to which the right of withdrawal is closely related, and because we are under a legal obligation arising from the seller's liability for non-conformity of goods with the contract.
We conduct marketing - we want to ask your opinion about our products and services, promote our products and services, and present offers and promotions tailored to your interests. We process the data in our marketing database because we have a legitimate interest in doing so, as explicitly defined in the provisions of the DPA (recital 47 of the DPA).
In order for us to conduct marketing, we perform profiling, which, however, in no case affects your rights or freedoms or otherwise similarly affects you. The basis for the processing is our legitimate interest that we have in promoting our products and services.
In addition, as long as you give separate consent to receive marketing communications (including newsletters) by e-mail or telephone, we will use your e-mail address and/or telephone number to communicate our store's commercial offerings. The basis for data processing is your voluntary consent, which you can give, for example, by signing up for our newsletter.
Provide clarification - if you ask us a question or raise a concern we process your personal data to respond so that we can provide you with the best possible experience when you contact us. The basis for processing is our legitimate interest in providing our customers and users with full information and ensuring that they have a positive experience with our stores.
4. HOW LONG DO WE KEEP YOUR PERSONAL INFORMATION?
For the purpose of performing sales, as well as delivery and installation services, we store data for the period of performance and settlement of the contract.
If you create a customer account in our online store, we will process your data until you delete your account).
If you have corresponded with us or contacted us via the hotline your data will be processed until we have provided you with all the necessary clarifications.
We process data for marketing purposes until you object to the processing of your data for marketing purposes. However, we keep most of the information we collect for marketing purposes for a period of no more than 14 days. In the case of marketing contact, we will cease such contact when you withdraw your consent to such contact.
After the periods indicated above, we may keep your data because:
(i) we are obliged to do so by law (e.g. tax regulations, accounting regulations, liability regulations for conformity of goods with the contract);
(ii) data may be necessary for us to demonstrate that our action was lawful (e.g., data about your consent to marketing contact);
(iii) the statute of limitations for your claims has not yet expired.
5. WHO IS THE RECIPIENT OF YOUR PERSONAL DATA? WHEN WE ACT ON BEHALF OF OTHER PERSONAL DATA CONTROLLERS?
We disclose your data to other entities only when it is necessary to perform the services you order or when it is necessary for our development and improvement of our offer. These are always entities specialized in a particular field that provide us with professional services to support sales in our online store. The types of entities to which we may disclose your data are:
(i) shipping companies (e.g. couriers) - so you can receive the purchased goods at the address you indicated in the order;
(ii) payment intermediaries - so you can make payment for purchases in our stores;
(iii) Companies that provide a comprehensive marketing, sales or CRM platform to help manage customer relationships, automate business processes and improve marketing, sales and customer service performance (e.g. HubSpot),
(iv) transportation companies - so you can get the goods from the store to the address you indicated at the time of purchase, including together with bringing, installation and collection of old equipment;
(v) companies that provide additional services that you order at the time of purchase or that provide services necessary for the fulfillment of orders - so that orders can be fulfilled;
(vi) services responsible for repairing equipment - so your complaint can be handled efficiently;
(vii) companies that provide IT services for us - thanks to this we can, among other things, maintain software used to run stores, Newsletter, sales records, etc...;
(viii) marketing agencies - so we can create interesting offers, promotions for you and communicate with you as our customer on an ongoing basis;
(ix) companies that collect product and store reviews - so you can share your opinion about the product or your impressions of using our store;
(x) Companies that provide legal or accounting services for us.
Whenever we disclose your data to others, we do so within the framework of applicable regulations. If our service providers process your data on our behalf, they must provide guarantees to implement technical and organizational solutions that will protect your personal data and meet the requirements of the General Data Protection Regulation (GDPR).
We process your personal data in certain cases not as a controller, but as a so-called processor who acts on behalf of other entities. As a result, you can receive additional services in our stores that enrich our offer and allow you to shop more easily and with more peace of mind. These are the following cases (when introduced):
(i) Equipment insurance services (Warranty Plus) - we act on behalf of insurance companies;
(ii) Installment purchases (consumer loans) - we act on behalf of banks;
(iii) leasing for companies - we act on behalf of the leasing entity;
(iv) telecommunications services.
6. WHAT RIGHTS DO YOU HAVE IN RELATION TO THE PROCESSING OF YOUR PERSONAL DATA?
Data protection law gives you a number of rights that you can exercise at any time. Your rights include:

You can also use a special link for this purpose, which is included in the footer of every marketing message you receive from us.
Please note that from the moment you withdraw your consent, it may take a certain amount of time before your application is accepted into the system and all databases synchronize. We will endeavor to ensure that these actions take place without undue delay, but in no case should it take longer than one month.
Remember that withdrawal of consent does not affect the lawfulness of the processing carried out on the basis of consent before its withdrawal.
If you consider that we have in any way violated the rules of processing your personal data then you have the right to file a complaint directly to the supervisory authority (President of the Office for Personal Data Protection, 2 Stawki Street, 00-193 Warsaw). In exercising this right, you should give a full description of the situation and indicate what action you consider to have violated your rights or freedoms. The complaint should be submitted directly to the supervisory authority at the address indicated above.
7. WHAT IS THE RIGHT TO OBJECT TO THE PROCESSING OF PERSONAL DATA?
Separately, we want to inform you that you also have the right to object to the processing of your personal data. You can object if, due to your particular situation, you do not want us to process your personal data for a specific purpose arising from our legitimate interests.
If you object, we will no longer process your data for the purpose to which your objection relates. Remember, however, that in some situations we may have valid, legitimate grounds for processing your data, which will take precedence over your interests, rights and freedoms. In some situations, the processing of your data may also be necessary to establish, assert or defend claims. In such cases, we will not be able to accommodate your objection.
If you object to the processing of your data for marketing purposes, you do not need to justify it in any way. Such an objection will always be taken into account by us.

8. WILL YOUR DATA BE TRANSFERRED OUTSIDE THE EUROPEAN ECONOMIC AREA (EOG)?
In running the website, we use tools provided by entities that are located outside the European Economic Area, and some of our service providers may store your data outside the aforementioned territory (e.g. Google, OpenAI, HubSpot).
If there could be transfers of information outside the European Economic Area, this will be done only within the framework of the procedures required by data protection regulations, thus:
(i) to such countries for which the European Commission has issued a decision stating that they provide an adequate degree of protection, or
(ii) in the absence of the aforementioned decision - upon the provision of adequate safeguards, and provided that enforceable rights of data subjects and effective legal remedies are in place, e.g., on the basis of the conclusion with the entity to which the data are to be transferred of standard data protection clauses adopted by the European Commission, equipped with additional safeguards - if necessary.
As part of our activities, we use services:
(i) OpenAI, Inc. (headquartered in the U.S.), which processes data on our behalf to perform functions [e.g., chatbot, data analytics].
(ii) HubSpot, Inc. (headquartered in the U.S.), which processes data to support customer relationship management, automate business processes and improve performance in the areas of marketing, sales and customer service.
Data transfers, if they occur, are carried out in accordance with the provisions of RODO. The European Commission has issued a decision allowing the transfer of personal data from the EU to the US in accordance with RODO. In July 2023, the EU-US Data Privacy Framework was adopted. The US was deemed to provide an adequate level of personal data protection, comparable to Europe's, through the introduction of binding safeguards, restrictions on access to data by US authorities, and dispute resolution mechanisms available to EU citizens.

The user has the right to access, rectify, delete or limit processing of his data. In addition, the user may withdraw consent to the processing of personal data, object to the processing and data portability.
